Per the Montgomery County Coroner, Theodore Agler was crossing Webster Street near East Monument Avenue when a 2005 Chevrolet Silverado struck him around 10:15 p.m.

Agler was sadly pronounced dead at Miami Valley Hospital on Monday.

The accident report has identified the driver of the Chevrolet involved in the incident as a 23-year-old West Milton man.

CRASH INVESTIGATION NEEDED

When a driver is under the influence, they can suffer from a lack of judgment, impaired vision, reduced coordination, and delayed reaction time. As a result, they end up causing an accident that can ruin people's lives.

According to the National Safety Council, 10 percent of all fatal automobile accidents are caused by drivers operating vehicles under the influence of alcohol, drugs, or other medications. These accidents are the second-leading cause of automobile fatalities in this country.

An independent investigation will be required to learn other potential factors in the case, including the results of a test or tests to determine the blood-alcohol content levels of the driver.

Candice Bond, an experienced DUI accident attorney, was interviewed and provided her thoughts on incidents such as this one.

“Serving as an advocate, an attorney can help compassionately guide a victim during this difficult time, protecting their legal rights while ensuring that drunk drivers are held accountable for their reckless actions,” said Bond, Managing Partner of Bond Legal.

WRONGFUL DEATH CLAIM

Pending the investigation results, the family members of Theodore Agler may be entitled to a wrongful death claim for medical and funeral expenses, the loss of love and companionship, pain and suffering, and emotional trauma.

“An incident is considered a wrongful death when either a person or entity commits a wrongful or negligent act resulting in a person's death,” said Stefano Formica, of Counsel with Bond Legal.

“When vehicle accident fatalities result from unsafe driving, aggressive or distracted driving, speeding, or driving under the influence, family members are usually left with the option to pursue a civil action against the responsible motorist.”
