Why did the SUV enter the intersection on FM 105?
While police investigate the exact cause of the collision, independent analysis is often required to determine right-of-way and sightlines at rural intersections.
Candice Bond, managing partner at Bond Legal, said, "Right-of-way questions at fatal intersection crashes rarely have simple answers, because the position of vehicles at impact, the timing of traffic controls, and each driver's approach path all require careful independent review."
"An attorney working for surviving relatives can bring in reconstruction specialists to build that picture before physical evidence is removed from the scene," added Bond, who is also a national legal analyst for Accident News.
According to TxDOT, many fatal motorcycle crashes involve collisions with other vehicles, often at intersections. In 2024, 1,050 people were killed in intersection or intersection‑related crashes statewide, highlighting the persistent danger of intersections.
What are the legal options for the victim's family?
Following a fatal crash, surviving family members often face immediate financial and emotional burdens while waiting for official police reports to be finalized.
"Official investigations into fatal crashes can take weeks or months to conclude, and families are rarely in a position to pause their own lives while that process unfolds. An attorney can step in during that gap, preserving time-sensitive evidence, fielding insurance inquiries, and making sure the family's interests are not being managed by someone else," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
Individuals involved in motorcycle accidents may have legal options. Consulting a personal injury attorney can help clarify rights and potential claims.
Texas wrongful death statute
Under Tex. Civ. Prac. & Rem. Code § 71.001, surviving family members may file a wrongful death action. Texas applies modified comparative fault (51% bar). The statute of limitations is 2 years.
Recoverable damages may include loss of financial support, loss of companionship and consortium, funeral expenses, and mental anguish.
