An eastbound 2016 Ram 2500 pickup truck was towing an enclosed trailer when the attachment failed. The trailer broke loose, crossed into the intersection, and struck the westbound mobility scooter rider, identified as Visneau.

Paramedics transported Visneau to Upstate University Hospital. Medical staff later pronounced her dead.

The pickup truck was operating for Big Kahuna Rentals Inc. at the time of the collision. The driver remained at the scene.

The New York State Police, Central Square Fire Department, Brewerton Volunteer Fire Department, and Menter Ambulance assisted deputies.

The crash remains under investigation.

How common are fatal intersection crashes in Oswego County?

While investigators examine the mechanical failure of the trailer, intersection safety remains a critical concern for vulnerable road users. Families navigating the sudden loss of a loved one face a complex path to justice when entities are involved.

Candice Bond, managing partner at Bond Legal, said, "What makes fatal mobility scooter crashes so particularly difficult is that the person operating the scooter had almost no margin for protection, and any larger vehicle moving even at moderate speed can produce catastrophic injuries upon impact."

"Legal teams supporting surviving relatives will often pursue crash reconstruction, analyze roadway conditions, and interview witnesses to build a clear picture of what contributed to a fatal outcome," added Bond, who is also a national legal analyst for Accident News.

What role does liability play in equipment failures?

When a vehicle's equipment fails, investigators look at maintenance logs, hitching procedures, and company safety protocols.

Individuals involved in vehicle incidents may have legal options. Consulting a personal injury attorney can help clarify rights and potential claims.

New York wrongful death statute

Under N.Y. EPTL § 5-4.1, surviving family members may file a wrongful death action. New York applies pure comparative fault. The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of parental guidance, funeral expenses, and the decedent's conscious pain and suffering.

"We understand just what families are forced to go through, and having their rights protected is vital. A wrongful death lawyer will stay updated on the official investigation and help protect their legal rights and best interests," explained Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
