Bryce Smith DUI accident on Cumberland Parkway, Cobb County, Georgia

The two-vehicle collision occurred at the intersection of Cumberland and Mt. Wilkinson parkways

Bryce Smith, 18, of Marietta, was injured in a two-vehicle car accident on Cumberland Parkway at Mt. Wilkinson Parkway in Cobb County, Georgia, on Tuesday, according to the Cobb County Police Department.

Brittany Jacks, 31, of Atlanta, was arrested and faces multiple charges including driving under the influence, serious injury by vehicle and failure to yield.

The southbound 2020 Chevrolet Trax attempted a left turn and crossed directly into the path of the oncoming 2001 Mercedes E320. The vehicles collided in the intersection at approximately 10:43 p.m.

Smith, who was driving the Mercedes, suffered minor injuries and declined medical treatment at the scene. Two passengers in his vehicle, Que’tonyanna Young and Kymani Russell, were transported to Wellstar Kennestone Hospital, along with Tommy Heaton, a passenger in the Chevrolet.

The crash remains under investigation. Police are asking anyone with information to contact the department.

Why did the Chevrolet turn into oncoming traffic on Cumberland Parkway?

While the exact sequence of events is still under review, authorities have already filed criminal charges against the at-fault driver. National Legal Analyst Stefano Formica, Of Bond Legal, noted that "In car accidents involving impaired driving, the criminal proceedings often run parallel to civil liability investigations, establishing a clear framework for negligence."

According to the Georgia Department of Transportation, alcohol-impaired driving remains a leading cause of intersection collisions statewide.

What are the legal options for the injured passengers?

Victims like Smith and his passengers often face sudden medical expenses and vehicle replacement costs through no fault of their own. Insurance adjusters frequently attempt to settle these claims quickly before the full extent of injuries is known.

National Legal Analyst Candice Bond, Managing Partner at Bond Legal, noted that "When multiple passengers are injured in car accidents, securing independent legal representation early ensures that all available insurance policies, including potential dram shop liability if a business overserved the driver, are thoroughly evaluated."

The police investigation will provide important evidence for any future claims.

Georgia personal injury and DUI liability

Injured parties typically have two years from the date of the crash to file a personal injury lawsuit under the state's statute of limitations. Recoverable damages in these civil actions can include past and future medical expenses, lost wages, property damage, and pain and suffering.
