Damaarkus Baines Killed in Beaumont Pedestrian Accident

Damaarkus Baines pedestrian accident on Martin Luther King Parkway, Beaumont, Texas

The fatal collision occurred on Martin Luther King Parkway near Calder Avenue

Damaarkus Baines, 29, of Beaumont, was killed in a pedestrian accident on MLK at Calder on Tuesday, according to police.

The crash occurred shortly after 10:30 p.m. when he attempted to cross the street and was struck by a vehicle, causing fatal injuries.

The driver involved in the collision remained at the location.

Investigators closed a large section of the intersection for several hours to process the scene. Police cordoned off the road from Broadway to North. All lanes reopened just after 1 a.m. Wednesday.

The crash remains under investigation.

Law enforcement and independent investigators will need to examine a multitude of secondary factors, including the vehicle's speed, the driver's level of attention, and the specific lighting and visibility conditions at the corner of MLK and Calder. Pedestrian deaths remain a critical safety issue in Texas, where pedestrians account for roughly one in five of all traffic-related death statewide.

According to the Governors Highway Safety Association, U.S. pedestrian deaths fell 11% in the first half of 2023.

"In pedestrian cases, it is vital to secure an attorney to protect the rights of the victim's family," said Candice Bond, a national legal analyst and managing partner at Bond Legal. "A skilled attorney can advocate for the family by conducting background checks, locating witnesses to the crash, and reviewing applicable insurance coverage."

For the grieving family, taking immediate steps to preserve evidence is important. "An independent legal team can issue spoliation letters to ensure that important data—such as the vehicle's electronic control module data and potential surveillance footage from nearby businesses—is not lost or destroyed," said Stefano Formica, a national legal analyst for Bond Legal.

Securing an attorney allows a victim's loved ones to focus on healing while professionals handle the complex process of dealing with insurance adjusters, accident reconstruction experts, and potential litigation. A thorough, independent probe ensures that all causes are brought to light and that the family's legal rights are fully protected.

In cases where negligence is a factor, the family of Damaarkus Baines may be entitled to a wrongful death claim. Families of wrongful death victims may seek damages for loss of companionship, pain and suffering, and emotional distress following a tragic accident.

"The stress and sorrow can be extremely overwhelming after losing a loved one in an accident," Bond added. "We understand just what families are forced to go through, and having their rights protected is vital. A wrongful death attorney will stay updated on the official investigation and help ensure that their legal rights and best interests are protected."
