Sedan driver ticketed for failing to yield at stop sign on Union Street
Darlene Chappell, 88, of Gates, was killed in a two-vehicle collision at Union Street and Stony Point Road on Sept. 7, according to the Ogden Police Department.
First responders arrived at 1:36 p.m. to find a westbound sedan that had been struck by a southbound SUV. Investigators determined the 74-year-old driver of the sedan failed to yield the right of way at a stop sign and issued her a traffic ticket. The 88-year-old passenger in the sedan was unresponsive at the scene and taken to Strong Memorial Hospital, where she died later that evening. The driver of the sedan remained hospitalized Wednesday but was expected to be released.
The 47-year-old SUV driver was also hospitalized and expected to be released. Two girls in the SUV, ages 6 and 16, were treated and discharged.
Police confirmed impairment was not a factor in the collision.
According to the New York State Comptroller’s 2024 report, New York recorded 1,175 traffic fatalities in 2022—the highest number since 2013.

New York wrongful death statute
Under N.Y. EPTL § 5-4.1, surviving family members may file a wrongful death action. New York applies pure comparative fault. The statute of limitations is 2 years from the date of death.
Recoverable damages may include loss of financial support, loss of parental guidance, funeral expenses, and the decedent's conscious pain and suffering.
