The northbound vehicle struck the off-duty police officer on Wesclin Road. Emergency crews arrived to find the victim suffering from severe head and chest trauma. They immediately began providing aid at the scene before transporting him to a local hospital. He later died from his injuries.

Sheriff Dan Travous stated there is no evidence the pedestrian did anything to cause the collision. Investigators have not announced if the driver will face criminal charges.

The victim had served as an officer with the New Baden Police Department since 2019.

The 219 fatal pedestrian collisions reported statewide in 2024 represent a nearly 10% increase from the previous year, according to Illinois Department of Transportation data.

In serious pedestrian crashes, crash reconstructionists frequently examine whether vehicle speed was a contributing factor in the driver's failure to stop or yield in time.

Candice Bond, managing partner at Bond Legal, who is also a national legal analyst for Accident News, said, "Distracted driving has become one of the leading contributors to fatal pedestrian crashes on roadways across the country, and the consequences for pedestrians with no protective barrier are simply catastrophic."

What does historical crash data reveal about rural corridors?

According to Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal, "We understand just what families are forced to go through, and having their rights protected is vital. A wrongful death lawyer will stay updated on the official investigation and help protect their legal rights and best interests."

Rural routes like Wesclin Road often lack dedicated pedestrian infrastructure, street lighting, and wide shoulders. Investigators will review the driver's actions, vehicle maintenance records, and environmental factors to determine liability.

Illinois wrongful death statute

Under 740 ILCS 180, surviving family members may file a wrongful death action. Illinois applies modified comparative fault (50% bar). The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of society, and grief.
