Edward Luyo Killed in Queens Hit-and-Run Accident

The fatal collision occurred on Whitney Avenue when a speeding driver struck and dragged the 44-year-old man
Edward Luyo, 44, of Elmhurst, was killed in a hit-and-run crash on Whitney Avenue near Macnish Street in Queens, New York, on Tuesday, according to police.
A westbound gray 2015 Nissan Versa struck Luyo midblock at approximately 4:30 p.m., dragging him half a block under the back wheel before speeding away.
Officers arrested 53-year-old Jose Dilone Duran about three hours later. He is charged with leaving the scene of an accident and failure to exercise due care.
Paramedics rushed Luyo to Elmhurst Hospital, where he died.
A co-worker who witnessed the crash provided the fleeing vehicle's license plate number to investigators.
The sudden loss of a family member to a fleeing driver leaves relatives grappling with both grief and the complexities of the justice system. While criminal charges address the state's case against the driver, families often must handle a separate legal path to secure accountability.
"When a driver leaves the scene of a fatal crash, it feels like a double betrayal to the grieving family," said National Legal Analyst Candice Bond, Managing Partner at Bond Legal. "Most of these drivers are caught within two days because there's always some physical evidence left behind that they didn't see."
How do criminal charges affect the Whitney Avenue investigation?
"There's a special kind of anger and hurt when a driver causes a death and then simply drives away," said National Legal Analyst Stefano Formica, Of Bond Legal. "Most people don't know that a paint chip smaller than a dime can identify the exact year and model of a car."

New York wrongful death statute
Under N.Y. EPTL § 5-4.1, surviving family members may file a wrongful death action. New York applies pure comparative fault. The statute of limitations is 2 years from the date of death.
Recoverable damages may include loss of financial support, loss of parental guidance, funeral expenses, and the decedent's conscious pain and suffering.
