Estela Garza Killed in Indio Pedestrian Accident

The 75-year-old Bermuda Dunes resident was struck by a white Audi sedan near Avenue 44
Estela Garza, 75, of Bermuda Dunes, was killed in a pedestrian crash at the corner of Golf Center Parkway and Avenue 44 on Saturday, according to the Indio Police Department.
A northbound white Audi sedan struck the woman at approximately 11 p.m. just after she stepped off the center median and into the road, investigators said. Paramedics performed lifesaving measures at the scene. Garza was taken to a local hospital and later pronounced dead.
The 50-year-old driver of the Audi remained at the crash site and cooperated with officers.
The crash adds to a rising toll in California, where urban and suburban corridors account for the majority of the state's 1,106 annual pedestrian death, according to the California Office of Traffic Safety (OTS).
Police closed Golf Center Parkway for three hours to conduct a traffic investigation.

Investigators will examine the lighting conditions, crosswalk visibility, and vehicle speeds at the Avenue 44 intersection. In pedestrian accidents such as this, traffic safety analysts note that intersection design often plays a critical role.
Candice Bond, managing partner at Bond Legal, said, "Crosswalks feel safe, but paint on pavement does not stop a speeding car, and plenty of fatal pedestrian collisions happen in spots where someone was doing everything right and still had no real chance to react."

Under Cal. Code Civ. Proc. § 377.60, surviving family members may file a wrongful death action. California applies pure comparative fault. The statute of limitations is 2 years from the date of death.
Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and the decedent's pre-death pain and suffering.
