How did the school bus collision occur on Bennett Street?
While the Greenwich Township Police Detective Unit continues to investigate the exact circumstances of the collision, authorities will likely examine the bus's safety equipment, including crossing arms and mirrors.
Andrew G. Finkelstein, managing partner at Jacoby & Meyers Law Offices and a national legal analyst for Accident News, said, “Fatal crashes involving a bus often demand extensive investigations involving weather conditions, lighting studies, and mechanical inspections. An attorney organizes evidence preservation, manages witness cooperation, reviews regulatory compliance, and provides guidance to families overwhelmed by documentation requirements and insurance complications during transportation inquiries involving multiple parties.”
According to the National Highway Traffic Safety Administration (NHTSA), from 2013 to 2022, there were 1,082 fatal school-transportation-related crashes nationwide, highlighting the critical need for stringent safety protocols during student drop-offs.
What are the legal options for families after a vehicle death?
The sudden loss of a child leaves families facing unimaginable grief alongside complex interactions with insurance adjusters.
"In vehicle accidents, families may pursue civil claims independent of any criminal investigations to secure resources for funeral expenses, counseling, and other damages," added Finkelstein.
Transportation companies often deploy rapid response teams to accident scenes, making independent legal representation important for affected families. Individuals involved in vehicle incidents may have legal options. Consulting a personal injury attorney can help clarify rights and potential claims.
New Jersey wrongful death claims
"Wrongful death claims involving transportation providers require immediate preservation of evidence, including telematics data and driver qualification files, to establish negligence," noted Finkelstein.
Families may seek compensation for medical expenses incurred prior to death, funeral costs, and the loss of companionship and future financial support. New Jersey law generally requires wrongful death lawsuits to be filed within two years of the date of death, making timely legal consultation essential to protect the family's rights.
