How common are fatal motorcycle crashes in Wisconsin?
Motorcycles represent a small share of registered vehicles, yet riders account for a disproportionate share of traffic deaths. Wisconsin DOT data shows motorcyclists made up about 17% of all traffic fatalities in 2025. Nationally, the fatality rate for motorcyclists is nearly 30 times higher per mile traveled than for passenger car occupants.
What factors are investigators examining at Hanley and Carmichael roads?
When a commercial vehicle or truck collides with a motorcycle, investigators typically examine right-of-way, speed, and driver attention.
Candice Bond, managing partner at Bond Legal, said, "Motorcycles offer almost no physical protection compared to a car, so a routine collision can turn deadly for a rider. Drivers frequently claim never noticing a motorcycle before impact, which raises real concerns about awareness on busy roads."
"An attorney can begin gathering traffic footage, business camera recordings, and witness statements quickly, since evidence tends to disappear once a roadway reopens after a fatal collision," added Bond, who is also a national legal analyst for Accident News.
For the family of Wagner, understanding the exact sequence of events that led to the crash will be critical. Authorities will likely review any available traffic camera footage, vehicle data recorders, and witness statements to determine liability.
Wisconsin wrongful death statute
Under Wis. Stat. § 895.04, surviving family members may file a wrongful death action. Wisconsin applies modified comparative fault (51% bar). The statute of limitations is 3 years.
Recoverable damages may include loss of financial support, loss of society and companionship, funeral expenses, and the estate's losses.
"Insurance adjusters sometimes move quickly after a fatal crash, and legal counsel often steps in early to keep surviving relatives from accepting a rushed settlement offer before medical bills, funeral costs, and long-term losses are fully understood and properly calculated," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
