59-year-old Enterprise man dies in two-vehicle collision at rural Crenshaw County intersection

Juan Lopez Martinez, 59, of Enterprise, was killed in a two-vehicle crash at the corner of Alabama 189 and Crenshaw County 43 near Brantley on June 28, according to the Alabama Law Enforcement Agency.​‌​‍‍‍‍‌​‍‌‌‌​‍​​‌‌​​​‌‌‍‍‌​​‍‌‍​​‌‍‌‌‍​‍‌‍​​‍​‌​​​‌​‍‍‍‍‌​‍‌‌‌​‍​​‌‌​​​‌‌‍‍‌​​‍‌‍​​‌‍‌‌‍​‍‌‍​​‍​‌​​​‌​‍‍‍‍‌​‍‌‌‌​‍​​‌‌​​​‌‌‍‍‌​​‍‌‍​​‌‍‌‌‍​‍‌‍​​‍​‌​​

Troopers are currently investigating the sequence of events that led to the early morning collision. No charges have been filed.

A 2016 Jeep Patriot driven by a 17-year-old struck a 2013 Honda Odyssey around 5:20 a.m. The impact crushed the van.

The passenger in the Odyssey, Martinez, died at the scene. The 27-year-old driver of the van was taken to Baptist Medical Center South in Montgomery with injuries. The teenage driver of the Jeep was taken to an area hospital.

The crash remains under investigation.

Troopers will analyze skid marks, vehicle damage, and event data recorders to determine right-of-way violations. The investigation will clarify which driver failed to yield at the rural junction. Investigators will also look at the speed of the Jeep Patriot prior to the impact.

Alabama wrongful death statute

Under Ala. Code § 6-5-410, surviving family members of a person killed in a traffic collision may file a wrongful death action in Alabama. The state applies contributory negligence (one of only 4 states) when determining liability. The statute of limitations for wrongful death claims is 2 years from the date of death.
