Kymani Russell injured in Cobb County car accident, police say

Atlanta woman charged with DUI after turning into oncoming traffic on Cumberland Parkway
Kymani Russell was injured in a two-vehicle crash on Cumberland Parkway at Mt. Wilkinson Parkway in Cobb County, Georgia, on Tuesday, April 14, according to the Cobb County Police Department.
The driver of the southbound 2020 Chevrolet Trax, 31-year-old Brittany Jacks of Atlanta, was arrested and charged with driving under the influence, serious injury by vehicle, and failure to yield.
Investigators said the Chevrolet attempted to turn left and entered the path of an oncoming 2001 Mercedes E320.
Russell, a passenger in the Mercedes, suffered minor injuries and was taken to a local hospital for treatment. Two other passengers involved in the collision suffered serious injuries and were taken to Wellstar Kennestone Hospital.
The Mercedes driver declined medical treatment at the scene.
The crash remains under investigation by local authorities.
How does a DUI charge impact the investigation on Cumberland Parkway?
While the criminal case against the at-fault driver proceeds, investigators will also examine the timeline leading up to the collision to determine where the impairment originated.
National Legal Analyst Stefano Formica, Of Bond Legal, noted that "In car accidents involving an impaired driver, independent investigations often look beyond the immediate crash scene to identify whether a commercial establishment over-served the motorist prior to the collision."
According to the National Highway Traffic Safety Administration, alcohol-impaired driving crashes account for nearly one-third of all traffic-related death nationwide.
What rights do injured passengers have in Georgia?
Passengers like Russell who are injured due to another driver's negligence are often caught in the middle of complex liability claims involving multiple insurance policies.
National Legal Analyst Candice Bond, Managing Partner at Bond Legal, noted that "Passengers injured in motor vehicle accidents have distinct legal standing to pursue compensation for medical expenses and recovery, entirely separate from the drivers involved in the collision."
Individuals involved in car accident incidents may have legal options. Consulting a personal injury attorney can help clarify rights and potential claims.
Georgia personal injury claims
Injured passengers may be entitled to compensation for emergency room visits, ongoing medical treatment, lost wages, and pain and suffering. Georgia law generally provides a two-year statute of limitations from the date of the crash to file a personal injury lawsuit, making the prompt preservation of evidence and police reports critical for a successful claim.
