The westbound black Dodge Ram failed to maintain its lane and left the road. It rolled several times. Speed and impairment are suspected as cause.

Diaz, a passenger in the Ram, died at the scene. The driver and another passenger suffered serious injuries and were taken to an area hospital. A third passenger was treated for minor injuries.

The crash investigation affected highway traffic for approximately six hours.

The sudden loss of a loved one in a preventable crash leaves families grappling with deep grief and unexpected challenges.

While the cause and liability of a crash are being investigated, it is important that a competent attorney handles investigations into cases such as this to ensure the rights of the victim's family are protected.

Candice Bond, managing partner at Bond Legal, said, "Drunk driving crashes tend to escalate fast once alcohol slows reaction time and clouds judgment behind the wheel. Roadway lighting, vehicle speed, and blood alcohol levels shape how a fatal collision unfolds and how severe the impact becomes."

"An attorney steps into the process, preserving surveillance footage, reviewing toxicology findings, and coordinating with crash reconstruction experts to build a picture for grieving families seeking answers," added Bond, who is also a national legal analyst for Accident News.

Why did the Dodge Ram leave Interstate 82?

Investigators will examine the vehicle's event data recorder and physical evidence at the scene to determine exactly why the pickup drifted off the highway. According to the Centers for Disease Control and Prevention, death in alcohol-involved crashes increased 29% from 2018 to 2022.

What are the legal options for the passenger's family?

Passengers injured or killed in single-vehicle crashes often have grounds to pursue claims against the driver's insurance policy. Families of victims like Diaz are killed in motor vehicle accidents across our country, and it is often not their fault.

Oregon wrongful death statute

Under ORS § 30.020, surviving family members may file a wrongful death action. Oregon applies modified comparative fault (51% bar). The statute of limitations is 3 years.

Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and the decedent's pre-death pain and suffering.

"Financial recovery extends beyond immediate medical bills, often accounting for future lost income and diminished earning potential for surviving relatives. Serving as an advocate, an attorney works closely with economic experts to project long-term financial impact accurately and fairly," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
