Because Mroz was identified and arrested in connection with the fatal hit-and-run in St. Charles, the focus shifts to the criminal and civil implications. Candice Bond, Managing Partner at Bond Legal, noted that "Having the proper resources is extremely important to investigate a hit-and-run accident case and prove negligence. Road conditions, signage visibility, and road lighting are all possible contributing factors that must be fully considered. These procedures are necessary for helping someone who has lost a loved one at the hands of a hit-and-run driver receive the justice and monetary compensation that they deserve." Beyond criminal prosecution, families of victims can also pursue civil claims.

An arrest in a hit-and-run case can significantly impact a subsequent wrongful death claim. It often provides important evidence and helps establish liability. However, the legal complexities remain. Stefano Formica, Of Counsel at Bond Legal, observed that "A thorough investigation is critical in hit-and-run cases to identify all responsible parties and uphold the victim's rights." This incident, stemming from a collision between an SUV and a motorcycle, highlights the importance of a thorough investigation.

Under 740 ILCS 180, surviving family members may file a wrongful death action. Illinois applies modified comparative fault (50% bar). The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of society, and grief.
