National Legal Analyst Candice Bond, Managing Partner at Bond Legal, noted that "I've seen families blindsided by how a simple walk to the park can end in such a terrible tragedy. If a car hits someone at forty miles per hour, there's an eighty-five percent chance they won't survive the impact."

Under Missouri's wrongful death statute (Mo. Rev. Stat. § 537.080), specific surviving family members, including spouses, children, or parents, may pursue a civil claim following a fatal incident caused by negligence. The state operates under a pure comparative fault system, which allows for the recovery of damages even if the decedent was partially responsible, though the total award is reduced by their percentage of fault.

Candice Bond of Bond Legal noted that "When a pedestrian is killed by a vehicle, the driver’s 'duty of care' is a central part of the legal review. This means drivers are expected to be extra careful in areas where people are walking, even if the pedestrian isn't exactly where they are supposed to be."

Statutory provisions in Missouri generally provide a three-year window from the date of death to file a wrongful death action. Recoverable damages typically encompass funeral and burial expenses, the reasonable value of services and companionship, and the wages the decedent would have earned. Investigating crash factors like electronic logging data and maintenance records is a critical component of determining liability.
