Sidney Brenwalt Charged in Elkins DUI Accident

Passenger killed after vehicle crashes into stream on Georgetown Road
A passenger was killed in a fatal DUI accident on Georgetown Road in Elkins, West Virginia, on Tuesday, and the driver was arrested, according to the Randolph County Sheriff's Office.
The southbound 2012 Ford Fiesta lost control, veered off the right side of the road, and descended into a stream. The vehicle struck a cement culvert and flipped onto its side, ejecting the passengers.
The passenger was pronounced dead at the scene by the West Virginia Office of the Chief Medical Examiner.
Sidney Austen Brenwalt, 31, of Beverly, was injured and taken to a hospital before being charged with DUI causing death.
A preliminary breath test showed Brenwalt had a blood alcohol content of 0.164, deputies said. He is being held at the Tygart Valley Regional Jail on a $100,000 cash-only bond.
Speed is also believed to be a factor.
The West Virginia State Police and local fire departments are assisting with the ongoing investigation.
While criminal charges hold the at-fault driver accountable, the family of the deceased passenger is left navigating a sudden and loss. In DUI accidents such as this, independent investigations are important to uncover all cause.
National Legal Analyst Candice Bond, Managing Partner at Bond Legal. "A death caused by a drunk driver is a preventable tragedy that leaves lasting pain. Even at the legal limit, a driver’s reaction time slows and their ability to notice what’s happening around them is reduced."
According to the National Highway Traffic Safety Administration, 11,904 people died in U.S. drunk driving crashes in 2024, accounting for about 30% of total traffic death.
How did the Ford Fiesta leave Georgetown Road?
Investigators are examining the physical evidence along the 3400 block of Georgetown Road to determine the exact sequence of events that led the vehicle into the stream. Crash reconstructionists will analyze tire marks, vehicle damage, and the cement culvert impact to corroborate the speed and impairment factors.
What are the legal rights of the passenger's family?
Beyond the criminal proceedings against the driver, the victim's estate may have grounds for a civil claim.
National Legal Analyst Stefano Formica, Of Counsel at Bond Legal. "We understand just what families are forced to go through, and having their rights protected is vital. A wrongful death lawyer will stay updated on the official investigation and help ensure that their best interests are taken care of. Relatives of wrongful death victims are entitled to seek damages for the loss of companionship, pain and suffering, and emotional distress following a tragic or catastrophic accident."
West Virginia wrongful death statute
Under W. Va. Code § 55-7-5, surviving family members may file a wrongful death action. West Virginia applies modified comparative fault (50% bar). The statute of limitations is 2 years.
Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and the decedent's pre-death pain and suffering.
