Charges are pending against a 23-year-old Tennessee resident who was driving a 2005 Dodge Caravan, investigators said. The van attempted to make a left turn onto Highway 107 and collided with the eastbound motorcycle, bringing both vehicles to a stop in the middle of the intersection.

The motorcyclist, Sutton, was wearing a helmet at the time of the collision but suffered fatal injuries and died at the scene.

Troopers have not released the name of the van driver as the investigation continues.

According to the Tennessee Department of Safety and Homeland Security, the state recorded 200 motorcycle death in 2023, reflecting a sharp increase in deadly collisions.

Why did the Dodge Caravan turn into the path of the motorcycle on Highway 25-70?

The sudden loss of a loved one leaves families searching for answers, particularly when a driver fails to yield the right of way.

In motorcycle accidents such as this, crash reconstructionists examine intersection geometry, sightlines, and vehicle speeds to determine why a turning drivers did not see an approaching rider.

Candice Bond, managing partner at Bond Legal, said, "Motorcycle riders face enormous danger whenever a left-turning vehicle crosses a path without yielding at a busy intersection. Perception and reaction time become central questions, since a turning driver may misjudge distance or speed."

"Legal counsel gathers witness statements, examines signal timing and reviews vehicle damage, working to protect surviving relatives from insurance disputes," added Bond, who is also a national legal analyst for Accident News.

What are the legal implications of pending charges in Cocke County?

While troopers determine whether to file formal criminal charges against the 23-year-old van driver, the parallel civil liability framework remains a critical consideration for the victim's family. Criminal proceedings focus on penalizing the at-fault driver, whereas civil actions address the financial and emotional devastation inflicted upon surviving relatives.

Sutton is survived by his fiancée, two sons, his mother, and several sisters, who now face the complex aftermath of a fatal collision.

Tennessee wrongful death statute

Under Tenn. Code § 20-5-106, surviving family members may file a wrongful death action. Tennessee applies modified comparative fault (50% bar). The statute of limitations is 1 year.

Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and mental anguish.

"Catastrophic motorcycle collisions at intersections trace back to a turning vehicle failing to yield right of way at a moment. Investigations review event data recorders, skid marks and roadway design to review perception errors contributing to tragedy," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
