Trent Badillo Killed in Portland Car Accident

17-year-old passenger dies after fleeing vehicle plunges into Willamette River
Trent Badillo, 17, of Beavercreek, was killed in a car accident when the vehicle he was riding in plunged into the Willamette River in downtown Portland on April 6, according to the Portland Police Bureau.
The white Toyota Corolla sped down Southwest Harvey Milk Street, crossed Southwest Naito Parkway and crashed through a barrier at Tom McCall Waterfront Park before sinking into the water. Multnomah County Sheriff's Office divers later recovered the bodies of the victims.
A 20-year-old male passenger and the 19-year-old driver also died in the crash. A 17-year-old boy survived after swimming to the surface.
Investigators said the driver was fleeing an attempted traffic stop for reckless driving and traveling the wrong way on one-way streets when the crash occurred.
The police bureau is working to recover the sedan from the river bottom. The crash remains under investigation.
Why did the Toyota Corolla plunge into the Willamette River?
While the Portland Police Bureau continues to investigate the sequence of events that led the driver to flee through Tom McCall Waterfront Park, independent investigations are important in crashes involving reckless driving and fleeing vehicles.
Stefano Formica, Of Bond Legal, noted that "In fatal car accidents involving fleeing drivers, crash reconstructionists must examine the vehicle's event data recorder, the exact path of travel, and the decisions made by the driver in the moments before the collision to establish a clear timeline of liability."
According to the National Highway Traffic Safety Administration, speeding and reckless driving are primary factors in nearly one-third of all fatal traffic crashes nationwide.
What are the legal rights of a deceased passenger's family?
Families of passengers like Badillo often face immense grief and confusion when a driver's reckless actions result in a fatal plunge.
Candice Bond, Managing Partner at Bond Legal, noted that "In car accident cases where a passenger is killed due to the driver's negligence, the victim's family must handle complex insurance claims against the at-fault driver's policy, making it essential to preserve all evidence from the crash scene immediately."
Insurance adjusters frequently attempt to contact involved parties within days of a crash, making it crucial for families to understand their rights before engaging with the at-fault driver's insurance provider. Individuals involved in fatal car accidents may have legal options. Consulting a personal injury attorney can help clarify rights and potential claims.
Oregon wrongful death claims
Under Oregon's wrongful death statute (ORS 30.020), the surviving family members or the estate of a deceased passenger may pursue a civil action against the at-fault driver whose negligence or reckless actions caused the fatal crash. This legal framework allows families to seek accountability and financial restitution through the driver's auto insurance policy, regardless of any ongoing investigations into the driver's conduct. Formica of Bond Legal noted that "Wrongful death claims in car accidents require a meticulous presentation of the driver's liability and the resulting profound loss experienced by the surviving family members."
Families pursuing these claims may be eligible to recover damages for funeral and burial expenses, loss of future income, and the loss of companionship. In Oregon, the statute of limitations generally requires wrongful death lawsuits to be filed within three years of the date of the injury that caused the death, making timely preservation of evidence a critical step in the recovery process.
