William Clifton Kirby Killed in Martinez Pedestrian Accident

William Clifton Kirby pedestrian accident on Washington Road, Martinez, Georgia

The 76-year-old Augusta man was struck by a vehicle in a fast-food restaurant parking lot on Washington Road

William Clifton Kirby, 76, of Augusta, was killed in a pedestrian crash in an Arby's parking lot at 3864 Washington Road in Martinez on Sunday, according to the Columbia County Sheriff's Office.

A car turning past a vehicle in a drive-thru line struck him as he walked north through the rear of the property, investigators said. The driver failed to see him during the turn.

Kirby was taken to a local hospital, where he died on Monday, according to Columbia County Coroner Terry Norman.

Deputies continue to investigate the collision.

Why did the driver fail to see the pedestrian in the Martinez parking lot?

While deputies investigate the visibility factors in the Martinez parking lot, safety analysts often examine how commercial property layouts and sightlines contribute to pedestrian collisions. National Legal Analyst Candice Bond, Managing Partner at Bond Legal, noted that adequate safety infrastructure and better sight triangles give drivers more time to react, yet they are not always prioritized in parking lot designs.

How common are fatal pedestrian accidents in Georgia?

The fatal collision on Washington Road reflects a growing danger for pedestrians across the state. Data from the Georgia Department of Transportation indicates that 84% of pedestrian deaths occur in low-visibility conditions, and deaths have increased 33% over a recent five-year period.

National Legal Analyst Stefano Formica, Of Bond Legal, observed that "I've seen families blindsided by how quickly a quiet walk turned into a nightmare. Research indicates that trucks and SUVs are three times more likely to kill a pedestrian than sedans because of their high hood geometry."

Following a fatal pedestrian accident, surviving family members frequently encounter immediate pressure from insurance adjusters before the full scope of liability—including potential premises liability for unsafe parking lot design—is established.

Georgia wrongful death statute

Under O.C.G.A. § 51-4-1, surviving family members may file a wrongful death action. Georgia applies modified comparative fault (50% bar). The statute of limitations is 2 years.

Recoverable damages focus on the full value of the life of the decedent, including both economic and intangible losses.
