30-year-old man truck accident on Cross Bronx Expressway, Tremont, New York

The chain-reaction collision occurred on the southbound Cross Bronx Expressway near Jerome Avenue

A 30-year-old man was killed and two others were injured in a chain-reaction truck accident on the southbound Cross Bronx Expressway near Jerome Avenue in Tremont early Thursday, April 16, police said.

The collision began when a Kia SUV stopped in the left lane for unknown reasons, causing a tractor-trailer to strike it. Moments later, a Toyota Corolla crashed into the rear of the commercial truck.

The driver of the Corolla died from his injuries. Paramedics took the driver and a passenger from the Kia to a local hospital, where they were listed in stable condition.

The driver of the tractor-trailer was not hurt. Authorities closed the southbound lanes for several hours during the investigation before reopening them for the morning commute.

According to the Federal Motor Carrier Safety Administration, New York State recorded 126 deaths in crashes involving large trucks in 2022.

Why did the Kia SUV stop on the Cross Bronx Expressway?

While authorities work to determine why the initial vehicle stopped in the active left lane, investigators will examine the commercial truck's telematics and the sequence of impacts. In multi-vehicle collisions, crash reconstructionists analyze skid marks, event data recorders, and driver logs to establish a timeline of events.

"When a family is mourning a loss involving a semi-truck, they deserve to know if safety was ignored," said Candice Bond, Managing Partner at Bond Legal. "Every commercial driver must log a pre-trip inspection, and it's those missing entries that often point to a preventable mechanical failure."

How does comparative negligence affect the Toyota driver's estate?

Because the Toyota Corolla rear-ended the tractor-trailer after the initial collision, liability may be divided among multiple parties, including the driver of the Kia SUV who stopped in the road. Families navigating the aftermath of a multi-vehicle commercial crash often face complex insurance claims involving multiple carriers and corporate defense teams.

"Nothing can replace the person who didn't come home after a collision with a semi-truck," said Stefano Formica, Of Bond Legal"Investigators look for daily inspection logs because missing entries often tell a story of skipped safety checks."

Individuals involved in commercial vehicle incidents may have legal options. Consulting a personal injury attorney can help clarify rights and potential claims.

New York wrongful death statute

Under N.Y. EPTL § 5-4.1, surviving family members may file a wrongful death action. New York applies pure comparative fault. The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of parental guidance, funeral expenses, and the decedent's conscious pain and suffering.
