California wrongful death statute
California law allows certain family members to pursue a wrongful death claim following a fatal accident. Under California Code of Civil Procedure § 377.60, designated heirs may seek damages for losses such as funeral and burial expenses, medical costs incurred before death, lost financial support, and loss of companionship. This statute enables recovery for both economic and non-economic damages when a death results from another party's negligence.
Formica noted that these claims require thorough legal and factual investigation to identify all potential sources of compensation for the family.
Statute of limitations under California law
A wrongful death lawsuit in California must generally be filed within two years from the date of the person's death. This time limit, known as the statute of limitations, is important for families to consider as they gather evidence and consult with legal counsel regarding the crash.
