A southbound Toyota Corolla struck the rear of a Polaris Ranger side-by-side that had just entered the highway from a field on the west side of the road. The collision caused the off-road vehicle to veer off the road, overturn and catch fire.

Martinez was taken to Hendrick Medical Center North before being flown to UMC Lubbock for further treatment of his injuries.

The driver and passenger of the ATV, both men, were ejected from the vehicle and pronounced dead at the scene.

Investigators noted that no passengers in either vehicle were wearing seatbelts at the time of the collision. Weather conditions were clear and the road was dry.

The crash remains under investigation.

Victims like Martinez often face long recoveries when sudden hazards enter their path of travel. While authorities continue to investigate the sequence of events that led the off-road vehicle onto the highway, independent investigations are often necessary to determine right-of-way violations and crash dynamics.

According to the Consumer Product Safety Commission, there were 179 ATV-related deaths in Texas from 2016 to 2024, highlighting the severe risks associated with off-highway vehicles entering public roadways.

Because this collision resulted in fatal injuries for the ATV passengers and injuries to Martinez, the legal and investigative dynamics become highly complex for all involved parties. Insurance adjusters frequently contact involved drivers within days of a collision, often before the full extent of medical costs and long-term effects are known.

Individuals involved in ATV accidents may have legal options. Consulting a personal injury attorney can help clarify rights and potential claims.

Under Tex. Civ. Prac. & Rem. Code § 71.001, surviving family members may file a wrongful death action. Texas applies modified comparative fault (51% bar). The statute of limitations is 2 years.

Recoverable damages may include loss of financial support, loss of companionship and consortium, funeral expenses, and mental anguish.
