Anthony Thompson Killed in Rochester Pedestrian Accident

The 53-year-old man was struck by a vehicle while waiting to cross Culver Road
Anthony Thompson, 53, was killed in a pedestrian crash on Culver Road on May 30, according to the Rochester Police Department.
The striking vehicle hit the man as he waited to cross the street outside a local business.
Paramedics transported Thompson to a local hospital, where he was pronounced dead.
Investigators determined the driver remained at the scene following the collision.
Police said drugs and alcohol do not appear to be factors in the crash.
The collision remains under investigation.
How do intersection mechanics impact pedestrian safety on Culver Road?
When pedestrians wait to cross busy commercial corridors, they are highly vulnerable to vehicles departing the travel lanes. Investigators will examine the striking vehicle's speed, trajectory, and the driver's level of distraction leading up to the impact.
In pedestrian accidents such as this, traffic safety analysts note that infrastructure and driver attention play critical roles in preventing death.
Candice Bond, managing partner at Bond Legal, said, "Distraction behind the wheel has become one of the most persistent dangers facing pedestrians today. A driver looking at a phone, adjusting a screen, or momentarily disengaged from the road can travel a significant distance without truly seeing what's ahead."
Legal counsel pursuing justice for surviving families often focuses on cellphone activity at the moment of a crash, because that evidence, if preserved quickly, can be decisive in understanding what actually happened, added Bond, who is also a national legal analyst for Accident News.
What does state data reveal about pedestrian risks?
The collision adds to a persistent safety challenge across the state. According to the National Highway Traffic Safety Administration, 75% of pedestrian death nationwide occur outside of marked intersections, highlighting the dangers pedestrians face along multi-lane roads.
"Fatal pedestrian crashes leave surviving families navigating overwhelming grief while critical evidence quietly disappears. Legal counsel understands that pressure and moves quickly, monitoring official investigations, preserving essential records, and protecting the legal rights of affected relatives," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
While the Rochester Police Department continues its probe, independent accident reconstruction is often required to determine exactly how a vehicle left its lane and struck a waiting pedestrian.
New York wrongful death statute
Under N.Y. EPTL § 5-4.1, surviving family members may file a wrongful death action. New York applies pure comparative fault. The statute of limitations is 2 years from the date of death.
Recoverable damages may include loss of financial support, loss of parental guidance, funeral expenses, and the decedent's conscious pain and suffering.
