LeRoy P. Smith Killed in Lockport Pedestrian Accident

The 81-year-old victim was struck by a vehicle Friday night on Sunset Drive
LeRoy P. Smith, 81, of Lockport, was killed in a pedestrian crash on Sunset Drive in Lockport, New York, on May 30, according to the State Police.
The nighttime collision occurred at approximately 9:30 p.m. in an area where visibility and lighting are currently under review by investigators. A 22-year-old driver from Grand Island struck the man with a vehicle.
Troopers arrived and immediately began CPR. Paramedics took Smith to a local hospital, where he later died.
The driver is cooperating.
The State Police Bureau of Criminal Investigation is handling the case. No charges have been filed.
The sudden loss of a beloved community member like Smith leaves families and neighbors searching for answers. While the Lockport community mourns, investigators are working to determine exactly how this tragedy unfolded on Sunset Drive.
Candice Bond, managing partner at Bond Legal, said, "Pedestrians have no protective barrier between themselves and an oncoming vehicle, which is why even collisions at moderate speeds can produce fatal outcomes that leave families completely unprepared. Darkness compounds that vulnerability significantly, stripping away the limited warning a pedestrian might otherwise have."
Legal counsel steps into that chaos early, working to secure lighting records, preserve physical evidence, and help surviving relatives understand what happened and what options remain available, added Bond, who is also a national legal analyst for Accident News.
What happens next in the Sunset Drive investigation?
The State Police Bureau of Criminal Investigation will examine skid marks, vehicle damage, and potential surveillance footage from the residential area. In pedestrian accidents such as this, independent reviews often supplement official reports to uncover all cause.
"An accident reconstruction team is sometimes needed to help piece together what happened following a fatal pedestrian crash. Such investigative resources can clarify circumstances and support efforts to evaluate damages and losses," Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
How do pedestrian death impact the Lockport community?
Traffic death deeply affect local neighborhoods and prompt discussions about roadway safety. According to the National Highway Traffic Safety Administration, 7,080 pedestrians died in traffic crashes nationwide in 2024. Each of these numbers represents a family navigating an unexpected and complex path forward. Individuals involved in pedestrian accidents may have legal options. Consulting a personal injury attorney can help clarify rights and potential claims.
New York wrongful death statute
Under N.Y. EPTL § 5-4.1, surviving family members may file a wrongful death action. New York applies pure comparative fault. The statute of limitations is 2 years from the date of death.
Recoverable damages may include loss of financial support, loss of parental guidance, funeral expenses, and the decedent's conscious pain and suffering.
