Chandler Hemenway Killed in Gainesville Truck Accident

The 19-year-old driver died after a semi-truck failed to yield at a highway crossover on US-82
Chandler Hemenway, 19, of Gainesville, was killed in a two-vehicle accident on US-82 near Miller Road in Gainesville, Texas, early Saturday, according to the Texas Department of Public Safety.
The crash occurred around 12:50 a.m. when a semi-truck turning eastbound from a highway crossover failed to yield the right of way and struck the passenger car. Emergency crews from Whitesboro, Sadler, and Southmayd responded to the scene, closing the intersection for several hours.
The 19-year-old driver of the passenger car was pronounced dead at the scene. The driver of the semi-truck was not injured.
The crash remains under investigation.
Authorities cleared the road and reopened lanes around 5 a.m.
Why did the semi-truck fail to yield on US-82?
Investigators are working to determine why the commercial vehicle pulled into the crossover path of the oncoming car. In truck accidents such as this, crash reconstructionists examine electronic logging devices, driver fatigue, and line-of-sight factors at highway intersections.
Candice Bond, managing partner at Bond Legal, said, "Fatigue among commercial truck drivers remains a persistent danger on long-haul routes, since hours-of-service violations and irregular sleep patterns can slow reaction time enough to turn an avoidable situation into a fatal outcome. Cellphone records sometimes reveal distraction layered on exhaustion."
"Legal counsel brought into such losses preserves electronic logging device data quickly, knowing dispatch pressure and scheduling demands shape events long before any collision," added Bond, who is also a national legal analyst for Accident News.
According to the National Highway Traffic Safety Administration, Texas leads the nation in commercial vehicle death, recording 712 deaths in large truck crashes in 2024.
What are the next steps for Hemenway's family?
The sudden loss of a young family member leaves relatives facing immediate emotional and logistical hurdles. While authorities continue their probe into the failure to yield, trucking companies often deploy their own investigators to the scene immediately to build a defense.
Texas wrongful death statute
Under Tex. Civ. Prac. & Rem. Code § 71.001, surviving family members may file a wrongful death action. Texas applies modified comparative fault (51% bar). The statute of limitations is 2 years.
Recoverable damages may include loss of financial support, loss of companionship and consortium, funeral expenses, and mental anguish.
"Filing a wrongful death claim allows surviving relatives to seek accountability for medical bills, funeral costs and lost financial support. An attorney reviews evidence, consults outside experts when needed and builds a case reflecting the true extent of family loss," explained Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
