Daniel DeMaio Killed in Ridgeway Car Accident

The 31-year-old passenger died after the vehicle left Highway 21 and struck numerous trees
Daniel DeMaio, 31, of Blackstock, was killed in a single-vehicle crash on Highway 21 North in Ridgeway, South Carolina, early Sunday, according to the Fairfield County Coroner's Office.
The northbound vehicle drifted off the road, traveled down an embankment and slammed into numerous trees. Rescue squad members and fire service personnel used heavy equipment to extricate the partially ejected passenger from the wreckage.
DeMaio was pronounced dead at the scene. An autopsy will be scheduled at a later date.
Authorities have not released the name of the driver or detailed what caused the loss of control. The crash remains under investigation.
South Carolina recorded 1,093 traffic death in 2022, according to the state Department of Public Safety.
The sudden loss of a family member in a single-vehicle crash leaves relatives searching for answers about how the driver lost control. While authorities continue to investigate the sequence of events on Highway 21, independent legal analysis is often necessary to uncover the full scope of liability.
Candice Bond, managing partner at Bond Legal, said, "Ejection risk climbs once a vehicle leaves the roadway at high speed, and passengers face brutal outcomes during a violent tumble across open terrain. Weather, fatigue, and mechanical strain often stack together before disaster strikes on a remote highway."
"Insurance companies move fast after fatal outcomes, so legal counsel steps in early to challenge lowball offers and protect surviving relatives from added financial strain," added Bond, who is also a national legal analyst for Accident News.
Why did the vehicle leave Highway 21?
Investigators will examine tire marks, road conditions, and vehicle data recorders to determine why the car traveled down the embankment. Single-vehicle run-off-road crashes frequently involve driver distraction, fatigue, or excessive speed.
What are the next steps for DeMaio's family?
For families navigating the aftermath of a fatal passenger accident, understanding insurance coverage is a critical step.
South Carolina wrongful death statute
Under S.C. Code § 15-51-10, surviving family members may file a wrongful death action. South Carolina applies modified comparative fault (51% bar). The statute of limitations is 3 years.
Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and mental shock and suffering.
"Families process grief differently, and rigid timelines rarely serve anyone during a wrongful death matter. A legal team adjusts pace to match individual circumstances, remains available beyond standard hours when needed, and treats compassion as inseparable from sound legal strategy," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
