Jaimie Capitulik Injured in Waterloo Car Accident at Rt 96 & Brewer Rd

The crash occurred at the intersection of State Route 96 and Brewer Road.
Jaimie Capitulik of Newark and her passenger, Shawn Ross, were injured in a two-car crash at State Route 96 and Brewer Road in Waterloo on Sunday, April 12, according to the Seneca County Sheriff's Office.
Deputies responded to the intersection around 11:30 a.m. Investigators determined the driver of a second vehicle pulled out in front of Capitulik and failed to yield the right of way.
The second driver was issued a uniform traffic ticket at the scene.
Capitulik and Ross were treated before being transported to Geneva General Hospital for further evaluation. The ticketed driver and a passenger were evaluated by North Seneca Ambulance crews and did not require additional treatment.
The crash remains under investigation. No further details were immediately released.
Investigators are working to determine why the other driver pulled into the path of Capitulik's vehicle. In car accidents such as this, crash reconstructionists examine sightlines, vehicle speeds, and intersection traffic controls.
National Legal Analyst Candice Bond, Managing Partner at Bond Legal, noted that "Most people don't know that sitting at a green light for too long can actually be dangerous. If a driver floors it on a stale green, they're much more likely to hit someone clearing the intersection."
Why did the second vehicle fail to yield on State Route 96?
While the sheriff's office issued a failure-to-yield ticket, a full review of the crash dynamics can provide important answers for the injured victims. Insurance adjusters often contact injured parties within days of a crash, before the full extent of medical costs and long-term impacts are known.
According to National Legal Analyst Stefano Formica, Of Bond Legal, "When I hear about a collision, I think about the physics of momentum transfer. Reconstructionists can tell if you tried to stop by looking at whether the cars stuck together or bounced, and that's vital."
What do investigators look for in Waterloo intersection collisions?
Capitulik and Ross now face medical evaluations and potential recovery periods following the sudden impact. Victims injured in motor vehicle accidents across our country often face mounting medical bills and uncertainty, and it is often not their fault.
New York personal injury framework
New York follows a pure comparative fault system with no-fault auto insurance. The statute of limitations is 3 years.
Under New York's no-fault system, PIP benefits cover medical expenses and lost wages up to $50,000 regardless of fault. To pursue a liability claim, injuries must meet the 'serious injury' threshold under Insurance Law § 5102(d).
