What factors are investigators examining on Batavia Oakfield Townline Road?
While the cause and liability of a crash are being investigated, it is important that a competent attorney handles investigations into cases such as this to ensure the rights of the victim's family are protected.
Candice Bond, managing partner at Bond Legal, said, "Sudden unsafe lane changes remain among the most common causes of serious motorcycle collisions, largely because drivers underestimate how quickly a motorcycle can approach from an adjacent lane on the highway."
"A legal team frequently examines traffic signal timing, roadway markings and witness statements to determine how a traffic collision actually occurred," added Bond, who is also a national legal analyst for Accident News.
According to the National Highway Traffic Safety Administration, 6,335 motorcyclists were killed in traffic crashes nationwide in 2023, representing 15% of all traffic deaths.
Why are motorcyclists particularly vulnerable in Oakfield crashes?
Families who lose a loved one in a motorcycle collision often face complex liability assessments as investigators reconstruct the sequence of events.
New York wrongful death statute
Under N.Y. EPTL § 5-4.1, surviving family members may file a wrongful death action. New York applies pure comparative fault. The statute of limitations is 2 years from the date of death.
Recoverable damages may include loss of financial support, loss of parental guidance, funeral expenses, and the decedent's conscious pain and suffering.
"Reviewing early settlement offers becomes essential work for a legal team after insurance companies extend quick proposals following a fatal crash. Premature acceptance gets prevented carefully, protecting surviving relatives from inadequate long-term financial outcomes during a vulnerable, difficult time," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
