17-year-old ejected from vehicle after tire failure on I-40 in Sampson County

Jonathan Mcgee, 17, of Fuquay-Varina, was injured in a solo-vehicle crash on Interstate 40 in Sampson County on Friday afternoon, according to the North Carolina Highway Patrol.

The crash occurred just after 5 p.m. near mile-marker 358.‌‌‌‍‌‌‍‌‍‌‌‍‌‌‍‍‍‌‌‌‌‌‍‍‍‌‌‌‌‌‌‍‌‌‌‍‌‌‍‌‍‌‌‍‌‌‍‍‍‌‌‌‌‌‍‍‍‌‌‌‌‌‌‍‌‌‌‍‌‌‍‌‍‌‌‍‌‌‍‍‍‌‌‌‌‌‍‍‍‌‌‌‌‌‌‍

The 2007 Toyota Yaris was driving east on I-40 when its back, right tire failed. The vehicle then traveled out of control, ran off the road to the left, and struck a cable guardrail. After impact, the Toyota rolled, entering the westbound lane of I-40, where it stopped facing west. Mcgee, a backseat passenger, was ejected from the vehicle. He was taken to Novant Health Hospital in Wilmington for treatment of his injuries.

Another backseat passenger was also ejected and died after being transported to ECU Medical Health Center. The front-seat passenger was taken to WakeMed in Raleigh. Arana was taken to ECU Medical Health Center.

This crash contributes to a concerning trend in Sampson County, where five people have died on highways in the last seven days.

The crash remains under investigation.

The crash that injured Mcgee and killed another passenger highlights the severe consequences of vehicle malfunctions and impaired driving. When a vehicle's components fail, the resulting loss of control can lead to devastating outcomes, particularly for unrestrained passengers.

Candice Bond, managing partner at Bond Legal, who is also a national legal analyst for Accident News, said, "Determining the exact cause of a fatal rollover crash demands prompt, methodical investigation, as physical evidence deteriorates rapidly and critical data can disappear within days of an incident. An experienced attorney can help surviving families preserve key evidence, coordinate forensic analysis, and protect important legal rights during an overwhelming period."

What do investigators look for in a tire failure incident?

Investigators examining a tire failure incident typically focus on several key areas. They will analyze the tire itself for signs of tread separation, punctures, or manufacturing defects. They also review vehicle maintenance records to determine if the tires were properly inflated and maintained. Road conditions at the time of the crash, including debris or potholes, are also considered. The goal is to pinpoint whether the failure was due to external factors, driver negligence, or a product defect.

How does impaired driving impact liability in such crashes?

According to Stefano Formica, who serves as a national legal analyst for Accident News and is of counsel at Bond Legal, "We understand just what families are forced to go through, and having their rights protected is vital. A wrongful death lawyer will stay updated on the official investigation and help ensure that their best interests are taken care of."

North Carolina wrongful death statute

Under N.C. Gen. Stat. § 28A-18-2, surviving family members may file a wrongful death action. North Carolina applies contributory negligence. The statute of limitations is 2 years.

Recoverable damages may include loss of financial support, loss of services and companionship, funeral expenses, and the estate's losses.
