The collision occurred when a 71-year-old failed to yield from a private driveway on Farmers Road
Joshua Pagett, 33, was killed in a motorcycle crash on Farmers Road in Washington Township, Clinton County, Ohio, on Friday, according to the State Highway Patrol.
The Wilmington Post is leading the investigation.
A 71-year-old driver attempting to enter the road from a private driveway failed to yield the right of way. Pagett's motorcycle struck the vehicle.
The collision sent the bike off the left side of the pavement, and the rider was ejected.
He suffered serious injuries and was taken to Miami Valley Hospital, where he later died.
The other driver suffered minor injuries.
Investigators noted Pagett was not wearing a helmet. The crash occurred just before 1:30 p.m.
Why did the vehicle fail to yield on Farmers Road?
Investigators are examining the rural stretch of Farmers Road where the 71-year-old driver pulled out from a private driveway. Failure to yield remains a leading cause of multi-vehicle collisions involving motorcycles. When a driver pulls into the path of an oncoming rider, the resulting impact often leaves the motorcyclist with critical or fatal injuries.
National Legal Analyst Candice Bond, Managing Partner at Bond Legal, stated, "In addition to the diligent work of law enforcement, an attorney can re-interview important witnesses, analyze any surveillance video from a crash scene, and obtain phone and texting records of the liable party."
How do rural driveway crashes affect Ohio motorcyclists?
State data shows that a majority of Ohio motorcycle crashes involve another driver at fault, frequently occurring when passenger vehicles enter rural roadways from private drives or side streets. The lack of structural protection on a motorcycle makes these sudden right-of-way violations particularly deadly. For grieving families, understanding the exact sequence of events that led to the failure to yield is an important step after a sudden loss.
Ohio wrongful death statute
Under Ohio Rev. Code § 2125.01, surviving family members may file a wrongful death action. Ohio applies modified comparative fault (51% bar). The statute of limitations is 2 years.
Recoverable damages may include loss of financial support, loss of services and companionship, funeral expenses, and the estate's losses.
