Juan Acevedo Archila Killed in Durham Pedestrian Accident
A 37-year-old driver faces DWI and vehicular death charges after striking the teen on South Miami Boulevard
Juan Jose Acevedo Archila, 18, was killed in a pedestrian crash on South Miami Boulevard early Sunday, according to the Durham Police Department.
Stephen Moore, 37, of Manson, was arrested and charged with driving while impaired, misdemeanor death by vehicle, and driving with a revoked license. Investigators also cited the driver for exceeding a safe speed and operating a vehicle without liability insurance.
The collision occurred around 2:05 a.m. in the 1300 block of the road. Archila had exited his disabled vehicle following a prior crash to assess the damage when a 2010 Nissan Sentra struck him and his car. Paramedics transported the teenager to a local hospital, where he was pronounced dead. The driver told officers the Nissan continued sliding due to rainy conditions.
The crash remains under investigation.
According to the National Highway Traffic Safety Administration (NHTSA), 229 pedestrians died in traffic collisions across North Carolina in 2023.

Because the at-fault driver was charged with having no liability insurance, the victim's family may need to rely on Uninsured drivers (UM) coverage to recover damages.
North Carolina wrongful death statute
Under N.C. Gen. Stat. § 28A-18-2, surviving family members may file a wrongful death action. North Carolina applies contributory negligence. The statute of limitations is 2 years.
Recoverable damages may include loss of financial support, loss of services and companionship, funeral expenses, and the estate's losses.
