Richard Collins Injured in Cherokee County Bicycle Accident

72-year-old driver arrested after fleeing the scene on Sugar Pike Road
Richard Collins, of Georgia, was seriously injured in a bicycle accident on Sugar Pike Road in Cherokee County, Georgia, on April 23, according to the Sheriff's Office.
Jerry Wayne Ross, 72, was arrested at a nearby home shortly after the crash. He faces six criminal charges, including hit-and-run, aggressive driving and failing to maintain a safe distance from a bicycle.
The driver honked excessively for about two minutes while following a group of riders from the North Georgia Cycling Association. The vehicle's side mirror struck one cyclist before hitting the ride leader, knocking him to the ground. The driver then fled the scene.
Paramedics treated the ride leader at the scene for road rash on his shoulder, elbow and knee. A subsequent medical evaluation revealed a fractured lower spine.
Ross blamed the cyclists. When questioned by deputies, he claimed the riders were in the road.
The crash remains under investigation.
How does Georgia's 3-foot passing law impact the Sugar Pike Road investigation?
While criminal charges address the driver's decision to flee the scene, a parallel civil investigation is often required to establish liability for the victim's medical recovery. National Legal Analyst Candice Bond, Managing Partner at Bond Legal. "Having the proper resources is extremely important to investigate a hit-and-run accident case and prove negligence. Road conditions, signage visibility, and road lighting are all possible contributing factors that are considered and must be thoroughly examined. These procedures are necessary for helping those who have been injured at the hands of a hit-and-run driver receive the justice and monetary compensation they deserve."
In 2023, Georgia recorded 23 bicyclist death, and 15% of all bicyclist crashes resulted in at least one serious or fatal injury, according to the Governor's Office of Highway Safety.
What legal options exist for hit-and-run victims with spinal fractures?
Victims recovering from severe injuries like spinal fractures often face mounting medical bills while navigating complex insurance claims. National Legal Analyst Stefano Formica, Of Counsel at Bond Legal. "Insurance companies often try to pressure victims to settle for a quick payout for far less than the case is worth. However, an attorney will vigorously advocate for their client to ensure they are treated respectfully and compensated fairly."
Individuals involved in bicycle accident incidents may have legal options. Consulting a personal injury attorney can help clarify rights and potential claims.
Georgia personal injury framework
Georgia follows a modified comparative fault (50% bar) system. The statute of limitations is 2 years.
Damages include economic and non-economic losses. Georgia does not cap non-economic damages in most personal injury cases.
