Rosa Hernandez, 73, was killed in a head-on crash on East Stan Schlueter Loop on June 1, according to the Killeen Police Department.‌‌‍‌‌‌‍‍‌‍‍‍‌‌‌‍‌‍‍‌‍‍‍‍‌‍‌‍‌‌‌‌‌‍‌‌‌‍‍‌‍‍‍‌‌‌‍‌‍‍‌‍‍‍‍‌‍‌‍‌‌‌‌‌‍‌‌‌‍‍‌‍‍‍‌‌‌‍‌‍‍‌‍‍‍‍‌‍‌‍‌‌‌

Paramedics rushed two people to Baylor Scott & White Medical Center after a westbound Toyota SUV crossed into oncoming traffic and struck a silver Kia SUV. The driver of the Toyota, who investigators suspect was impaired, was pronounced dead at the scene.

Hernandez, a passenger in the Kia, later died from her injuries at the hospital. The 77-year-old man driving the Kia remains hospitalized in critical but stable condition.

The police department's Traffic Unit and Criminal Investigation Division are handling the case. An autopsy was ordered for the wrong-way driver at the Southwest Institute of Forensic Sciences in Dallas.

No further details have been released as the investigation continues.

What is the status of the Killeen crash investigation?

While the cause and liability of a crash are being investigated, it is important that a competent attorney handles investigations into cases such as this to ensure the rights of the victim's family are protected. In car accidents such as this where impairment is suspected, investigators will look closely at the at-fault driver's activities prior to the collision.

Candice Bond, managing partner at Bond Legal, said, "When suspected drunk-driving crashes result in fatalities, families are often left navigating insurance disputes, incomplete investigations, and profound financial uncertainty all at once."

A legal team can preserve critical evidence, secure key records, and help surviving relatives understand available compensation options, added Bond, who is also a national legal analyst for Accident News.

According to the Texas Department of Transportation, the state recorded 4,291 motor vehicle crash deaths in 2023.

How do wrong-way collisions impact victims?

The tragic loss of a loved one in a sudden collision leaves families searching for answers. Insurance adjusters often contact injured parties or grieving families within days of a crash, before the full extent of the impact is known.

"Alcohol-related crashes often destroy physical evidence almost instantly, which is why early legal intervention matters so much for affected families. A legal team can issue preservation letters, coordinate with reconstruction engineers, and demand electronic vehicle data before insurance companies and opposing parties have any real opportunity to influence or quietly minimize the available record," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.

Texas wrongful death statute

Under Tex. Civ. Prac. & Rem. Code § 71.001, surviving family members may file a wrongful death action. Texas applies modified comparative fault (51% bar). The statute of limitations is 2 years.

Recoverable damages may include loss of financial support, loss of companionship and consortium, funeral expenses, and mental anguish.
