Samir Weiss Arrested in Newport Beach Bicycle Accident

BMW driver faces assault charge following Pacific Coast Highway confrontation
A cyclist was injured and a Corona man was arrested following a road rage incident on Pacific Coast Highway in Newport Beach on March 21, according to the Newport Beach Police Department.
Samir Weiss faces charges of assault with a deadly weapon and obstructing arrest. Officers executed a search warrant at his home on March 26 and seized a blue BMW M3 as evidence.
Video footage showed the BMW tailgating two cyclists in a designated bike lane, forcing one rider onto the sidewalk. A passenger in the vehicle also threw a water bottle at the riders.
The confrontation escalated miles away near a Shake Shack, where four individuals exited their vehicles and physically blocked the cyclists. One injured rider was taken to a local hospital for medical treatment.
The investigation remains ongoing.
While the criminal justice system penalizes reckless driving, injured cyclists often face a separate battle for physical and financial recovery. Aggressive driving incidents on routes like Pacific Coast Highway require thorough independent investigation to secure important evidence before it disappears.
Individuals injured in bicycle collisions may have legal options.
California follows a pure comparative fault system. Injured parties may recover damages reduced by their percentage of fault. The statute of limitations is 2 years from the date of the crash.
Damages include economic losses (medical bills, lost income, rehabilitation) and non-economic losses (pain, suffering, emotional distress).
