Man Killed in Bakersfield Train Accident

Union Pacific Railroad Police investigating after pedestrian struck near Q and James streets
A male pedestrian was killed in a train accident near the corner of Q and James streets in Bakersfield, Kern County, California, on Monday, April 20, according to the Bakersfield Police Department.
Emergency medical personnel responded to the tracks just before 9 p.m. and pronounced the man dead at the scene. Union Pacific Railroad Police also arrived to secure the area and assumed control of the investigation.
Authorities have not released the victim's name or age pending notification of his family.
According to the Federal Railroad Administration, California recorded 48 death and 65 injuries from 182 highway-rail grade crossing collisions in preliminary 2025 data, ranking second nationally for such incidents.
The crash remains under investigation.
Families who lose a loved one in a commercial rail collision often face a complex investigative process involving both local authorities and corporate entities. While Union Pacific Railroad Police examine the circumstances of the Bakersfield incident, independent safety analysts emphasize the importance of preserving evidence at the crossing.
National Legal Analyst Candice Bond, Managing Partner at Bond Legal. "It's frightening how fast a train can appear even when you're being careful at a crossing. Every year, there are more than 2,000 incidents at grade crossings, leading to over 200 fatalities."
What factors do investigators examine in a train collision?
In train accidents such as this, corporate investigators are often dispatched immediately to protect the rail company's interests. Federal Railroad Administration data shows that the national death rate for crossing collisions hovers around 12.6 percent, underscoring the severe risks pedestrians face near active tracks.
National Legal Analyst Stefano Formica, of Counsel at Counsel at Bond Legal. "We understand just what families are forced to go through, and having their rights protected is vital. A wrongful death lawyer will stay updated on the official investigation and help ensure that their best interests are taken care of. Relatives of wrongful death victims are entitled to seek damages for the loss of companionship, pain and suffering, and emotional distress following a tragic or catastrophic accident."
How does comparative negligence affect pedestrian rail incidents?
Even if a pedestrian was on the tracks, California's legal framework provides avenues for grieving families to seek accountability if the train operator or company failed to follow strict federal safety mandates regarding speed, signaling, or braking procedures.
California wrongful death statute
Under Cal. Code Civ. Proc. § 377.60, surviving family members may file a wrongful death action. California applies pure comparative fault. The statute of limitations is 2 years from the date of death.
Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and the decedent's pre-death pain and suffering.
