Seraphina Fadick Killed in Encinitas Pedestrian Accident

The 17-year-old was struck by a westbound vehicle on El Camino Del Norte
Seraphina Rose Fadick, 17, of Escondido, was killed in a pedestrian crash on El Camino Del Norte at La Quebrada in Encinitas, California, on July 10, according to the San Diego County Sheriff's Department.
The westbound vehicle struck the teenager around 7:15 p.m. as the driver traveled toward the coast. The drivers immediately stopped at the scene and told investigators that road glare from the setting sun obstructed his vision.
Paramedics and a bystander attempted to render aid, but Fadick was pronounced dead at the scene.
Deputies confirmed the driver was not injured. Investigators do not believe drugs or alcohol played a role in the collision.
A sidewalk shrine has begun to grow at the intersection as community members mourn the loss. Local residents have raised concerns about vehicle speeds along the corridor, noting a bicyclist was seriously injured just three blocks away in February.
According to the National Highway Traffic Safety Administration (NHTSA), 1,106 pedestrians were killed in California traffic crashes in 2023.
Families navigating the sudden loss of a teenager face an unimaginable path forward, especially when a young life is cut short in a crosswalk. While the driver cited sun glare as a factor, investigators will examine whether appropriate speed and caution were exercised.
Candice Bond, managing partner at Bond Legal, said, "Pedestrian fatalities tend to spike where roadway design fails people on foot, wide intersections, missing crosswalks, poor lighting, and roads built for speed over safety. Add a distracted or drowsy driver and outcomes turn catastrophic almost every time."
"A legal team works to piece together events, gathering skid marks, signal timing records, and weather data to build a clear picture for surviving relatives left behind," added Bond, who is also a national legal analyst for Accident News.
Why did the collision occur on El Camino Del Norte?
Law enforcement will reconstruct the scene to determine the vehicle's speed and the driver's exact line of sight at 7:15 p.m. Even with environmental challenges like sun glare, drivers maintain a legal duty of care to yield to pedestrians.
What resources are available for the victim's family?
As the Encinitas community builds a memorial for the Escondido teen, her family will need time to grieve. During this period, independent investigators often secure witness statements, review neighborhood security footage, and analyze the driver's phone records to preserve critical evidence.
California wrongful death statute
Under Cal. Code Civ. Proc. § 377.60, surviving family members may file a wrongful death action. California applies pure comparative fault. The statute of limitations is 2 years from the date of death.
Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and the decedent's pre-death pain and suffering.
"Legal counsel moves swiftly after catastrophic crashes to secure vehicle data, medical records, and mechanical evidence before critical details fade," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
