How common are fatal hit-and-runs in Orange County?
Hit-and-run collisions remain a severe public safety issue across Southern California, with pedestrians bearing the brunt of the impact. When drivers flee the scene of a collision, victims like Cox are often left without immediate medical aid, significantly decreasing their chances of survival.
National Legal Analyst Stefano Formica, Of Counsel at Bond Legal, noted that "Hit-and-run pedestrian accidents frequently involve excessive speed or driver distraction, and the decision to flee often stems from impairment, lack of insurance, or outstanding warrants."
What evidence will investigators look for on Alton Parkway?
As detectives search for the dark-colored vehicle, they will likely canvas businesses near Irvine Center Drive for surveillance footage. Traffic cameras, debris left in the crosswalk, and automated license plate readers are critical tools in tracking down fleeing drivers. According to the AAA Foundation for Traffic Safety, hit-and-run death have trended upward nationally, reaching 2,854 deaths in 2022.
While the criminal investigation remains active, families of hit-and-run victims often face immediate financial and emotional burdens. Identifying the at-fault driver is most important for both criminal justice and civil liability.
California wrongful death statutes
If the driver is identified, California's pure comparative negligence system applies, meaning compensation can be awarded even if the pedestrian is found partially at fault, though damages are reduced by their percentage of responsibility. Families typically have two years from the date of the crash to file a wrongful death lawsuit, seeking compensation for funeral expenses, lost future income, and loss of consortium.
