While authorities work to determine what caused the delivery vehicle to veer into oncoming traffic, investigators will likely examine the driver's hours of service and the truck's maintenance records. National Legal Analyst Candice Bond, Managing Partner at Bond Legal, noted that "When a community loses someone to a large truck, the grief's often mixed with a search for answers. Electronic logging devices show exactly when a driver was behind the wheel, making it impossible to hide fatigue."

Corporate delivery fleets are equipped with advanced tracking systems that record speed, braking, and steering inputs in the moments before an impact. National Legal Analyst Stefano Formica, Of Bond Legal, noted that "What most people miss about last-mile delivery vans is the extreme time pressure these drivers are under. Telematics data can show us their speed and phone use in real time, so we'll know the truth."

Families who lose a loved one in a commercial collision often face immediate contact from corporate risk management teams seeking to limit liability. Early preservation of electronic data and dashcam footage is critical in establishing a timeline of events before the vehicles are repaired or destroyed.

Under Tex. Civ. Prac. & Rem. Code § 71.001, surviving family members may file a wrongful death action. Texas applies modified comparative fault (51% bar). The statute of limitations is 2 years.

Recoverable damages may include loss of financial support, loss of companionship and consortium, funeral expenses, and mental anguish.
