Two Killed in Wever Car Accident on Green Bay Road IA

Single-vehicle rollover on Green Bay Road adds to local roadway fatality statistics
A Fort Madison man and a Wever woman died Saturday when their car crashed on Green Bay Road in Wever, Iowa, according to the Iowa State Patrol.
The 61-year-old man drove a 2000 Lexus 400 northbound when it crossed the center line, police said. The car entered the west ditch and hit an embankment before it rolled over.
Rescuers found the Lexus resting on its roof at a field entrance. Both the driver and his 50-year-old passenger died at the scene, authorities said.
The crash remains under investigation by the Iowa State Patrol.
The Iowa State Patrol Post 13 is the primary agency managing the investigation, led by Trooper Ellison. Personnel from the Lee County Sheriff’s Office, Weaver Fire, and Lee County Ambulance responded to provide emergency aid and traffic control. Following the recovery of the victims, the vehicle was removed by Dunkin Towing as investigators processed the embankment where the initial collision occurred. The corridor was reopened once the scene was cleared on Saturday night.
National Legal Analyst Candice Bond, Managing Partner at Bond Legal, noted that "I've seen families blindsided by how quickly a simple commute turns into a heartbeat of loss. It's devastating that left-turn crashes account for over twenty percent of all fatal intersection accidents."
Iowa wrongful death statute
In Iowa, a wrongful death claim may be pursued by the personal representative of a deceased person's estate under Iowa Code Chapter 633A. This action allows for the recovery of damages on behalf of surviving family members. Damages in such cases typically include medical and funeral expenses, compensation for lost financial support, and the loss of companionship and services.
Comparative fault in Iowa
Iowa operates under a modified comparative fault system. This framework permits a claimant to recover damages as long as their attributed negligence does not exceed 51 percent. Any compensation awarded is reduced proportionally by the percentage of fault assigned to the deceased individual. Bond noted that these cases often involve complex determinations of fault, which can significantly affect the outcome for families.
Statute of limitations under Iowa law
Iowa law generally requires that a wrongful death action be filed within two years from the date of the individual's death. Adhering to this statute of limitations is important for families seeking to protect their legal rights while investigations into the crash are ongoing.
