Single-vehicle rollover on Green Bay Road adds to local roadway fatality statistics

A Fort Madison man and a Wever woman died Saturday when their car crashed on Green Bay Road in Wever, Iowa, according to the Iowa State Patrol.

The 61-year-old man drove a 2000 Lexus 400 northbound when it crossed the center line, police said. The car entered the west ditch and hit an embankment before it rolled over.

Rescuers found the Lexus resting on its roof at a field entrance. Both the driver and his 50-year-old passenger died at the scene, authorities said.

The crash remains under investigation by the Iowa State Patrol.

The Iowa State Patrol Post 13 is the primary agency managing the investigation, led by Trooper Ellison. Personnel from the Lee County Sheriff’s Office, Weaver Fire, and Lee County Ambulance responded to provide emergency aid and traffic control. Following the recovery of the victims, the vehicle was removed by Dunkin Towing as investigators processed the embankment where the initial collision occurred. The corridor was reopened once the scene was cleared on Saturday night.

National Legal Analyst Candice Bond, Managing Partner at Bond Legal, noted that "I've seen families blindsided by how quickly a simple commute turns into a heartbeat of loss. It's devastating that left-turn crashes account for over twenty percent of all fatal intersection accidents."

Under Iowa Code Chapter 633A, the personal representative of a decedent’s estate may pursue a wrongful death claim to recover damages on behalf of surviving family members. The state utilizes a modified comparative fault system, which allows for recovery as long as the claimant's negligence does not exceed 51 percent; however, any awarded compensation is reduced by the percentage of fault attributed to the deceased.

In Iowa, damages in these cases typically cover medical and funeral expenses, loss of financial support, and the loss of companionship and services. The statute of limitations generally requires that a wrongful death action be filed within two years of the date of the decedent's passing. Understanding these timelines is crucial for families seeking to preserve their legal rights while the investigative process remains ongoing.
