National Legal Analyst Candice Bond, Managing Partner at Bond Legal, noted that "I've seen families blindsided by how quickly a simple commute turns into a heartbeat of loss. It's devastating that left-turn crashes account for over twenty percent of all fatal intersection accidents."
Iowa wrongful death statute
Iowa law allows certain family members to pursue a wrongful death claim when a death results from another party's negligence or wrongful act. Under Iowa Code § 611.20, a cause of action for wrongful death may be brought by the personal representative of the deceased person's estate. Damages that may be recovered in a wrongful death action include medical and funeral expenses, loss of the deceased's future earning capacity, and loss of companionship and comfort.
Comparative fault in Iowa
Iowa follows a modified comparative fault system, as outlined in Iowa Code § 668.3. This means that if the deceased or injured party is found to be partially at fault for the accident, their recoverable damages may be reduced proportionally. However, if their fault is determined to be 51% or greater, they are generally barred from recovering any damages. In cases involving a wrong-way driver, liability often focuses on the actions of the driver who crossed into oncoming traffic.
Bond noted that police reports and forensic evidence from the crash scene are often key in determining liability in these types of incidents.
