The driver who struck Brown was arrested at the scene on suspicion of driving under the influence.

Investigators determined the victim was hit by a vehicle just after midnight. Brown was pronounced dead following the collision. His sister, Villeen Miles, said he was actively working to turn his life around.

The crash remains under investigation.

Authorities have not released the driver's name or specified if additional charges will be filed.

Why did the collision occur near Watt Avenue?

While the California Highway Patrol continues to investigate the suspected DUI, families navigating the sudden loss of a loved one face a complex path to justice. Criminal charges hold a driver accountable to the state, but a parallel civil investigation is often necessary to protect the victim's estate.

Candice Bond, managing partner at Bond Legal, said, "Alcohol and drugs slow reaction time dramatically, and a driver who cannot stop quickly enough often strikes a pedestrian with devastating force before any chance to swerve or brake exists. Toxicology results and witness statements become critical pieces of serious cases."

"Legal counsel works to obtain those records, since impairment evidence can fade or get contested as time passes," added Bond, who is also a national legal analyst for Accident News.

According to the Governors Highway Safety Association, 1,106 pedestrians were killed in motor vehicle crashes across California in 2023. That figure represents an 8.8 percent drop from the year before, but safety experts say the toll still highlights the severe risks vulnerable road users face on the state’s busy streets.

What are the legal options for pedestrian accident victims?

Even when a pedestrian is outside a crosswalk, drivers have a fundamental duty to exercise due care, especially when impairment is suspected.

"A common misconception suggests that stepping outside a marked crossing strips away any protection under the law, yet roadway rules still require attention and caution from every driver passing through," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.

California wrongful death statute

Under Cal. Code Civ. Proc. § 377.60, surviving family members may file a wrongful death action. California applies pure comparative fault. The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and the decedent's pre-death pain and suffering.
