Brayan Romael Cajas Sales Killed in Oakwood Car Accident
The single-vehicle rollover crash occurred on U.S. Highway 270 near East 730 Road
Against a backdrop of 639 traffic fatalities recorded across Oklahoma last year, a 22-year-old Plano, Texas, man was killed in a single-vehicle rollover crash on U.S. Highway 270 near East 730 Road in Oakwood on Sept. 5, according to the Oklahoma Highway Patrol.
The Highway Patrol is actively investigating the circumstances of the early morning wreck. Troopers responded to the scene approximately 2.3 miles northwest of town at 5:38 a.m. The southeast-bound vehicle drifted off the left side of the highway and overturned. The driver, a 20-year-old Las Vegas man, was not injured.
Brayan Romael Cajas Sales, a passenger in the vehicle, was pronounced dead.
Another passenger suffered injuries and received medical attention.
No charges have been announced.
Why did the vehicle leave U.S. Highway 270?
Investigators are working to determine what caused the driver to lose control and veer off the left side of the rural highway. Oklahoma wrongful death statute
Under Okla. Stat. tit. 12 § 1053, surviving family members may file a wrongful death action. Oklahoma applies modified comparative fault (51% bar). The statute of limitations is 2 years.
Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and grief damages.
"Excessive speed or sudden tire blowout maneuvers can cause high-center vehicles to experience catastrophic single-vehicle rollover events," said Stefano Formica, of counsel at Bond Legal.
