Bryce Smith Injured in Cobb County Car Accident

31-year-old driver arrested on DUI, serious injury charges following two-vehicle collision
Bryce Smith, 18, of Marietta, was injured in a two-vehicle crash on Cumberland Parkway at Mt. Wilkinson Parkway in Cobb County, Georgia, on Tuesday, according to the Cobb County Police Department.
Brittany Jacks, 31, of Atlanta, was arrested and charged with driving under the influence, serious injury by vehicle and failure to yield. Investigators determined the southbound 2020 Chevrolet Trax she was driving attempted a left turn directly into the path of an oncoming 2001 Mercedes E320.
Smith, who was driving the Mercedes, suffered minor injuries and declined medical treatment. Three passengers involved in the collision, including two people riding in the Mercedes, were transported for medical treatment.
Two of the passengers suffered serious injuries and were taken to Wellstar Kennestone Hospital. The crash remains under investigation, and authorities are asking witnesses to contact the police department.
Why did the Chevrolet turn into oncoming traffic on Cumberland Parkway?
While criminal charges have been filed against the driver of the Chevrolet, investigators will continue to examine the timeline of events leading up to the collision. National Legal Analyst Stefano Formica, Of Bond Legal, noted that "In car accidents involving impaired driving, independent investigations often reveal a pattern of delayed reaction times and poor distance judgment that directly contribute to intersection collisions."
According to the National Highway Traffic Safety Administration, alcohol-impaired driving crashes account for nearly one-third of all traffic-related death nationwide, highlighting the severe risks posed by intoxicated drivers on local roadways.
What are the legal rights of passengers injured in a DUI crash?
Victims like Smith and the passengers in his vehicle often face sudden medical expenses and recovery challenges following a crash caused by an impaired driver. National Legal Analyst Candice Bond, Managing Partner at Bond Legal, noted that "When analyzing DUI car accidents, it is crucial to look beyond the immediate criminal charges to ensure all avenues of civil liability, including potential dram shop claims against establishments that may have overserved the driver, are thoroughly evaluated."
The parallel civil process allows injured parties to seek financial recovery for their damages regardless of the outcome or timeline of the criminal prosecution against the at-fault driver.
Georgia personal injury and dram shop laws
Victims typically have two years from the date of the crash to file a personal injury lawsuit in Georgia. Because evidence such as surveillance footage, bar receipts, and witness statements can disappear quickly, prompt preservation of these elements is critical for building a full civil case.
