Two other Illinois Tollway workers were injured in the early morning collision on Interstate 294

Calvin L. Holley, 52, of Chicago, was killed and two others were injured in a pedestrian crash on Interstate 294 in Des Plaines early Saturday, according to the Illinois State Police.‍‍‌‌‍‍‌‌‌‌‍‍‌‍‍‌‍‍‌‌‌‍‍‌‌‌‌

The southbound vehicle struck the three Illinois Tollway maintenance workers around 4:30 a.m. near milepost 41.5 as they filled potholes.

Paramedics transported the crew to a nearby hospital, where the Cook County Medical Examiner's Office pronounced the 52-year-old dead. The conditions of the other two workers were not immediately released.

No charges have been filed against the driver as the crash remains under investigation. The crash adds to a concerning trend, as the Illinois Department of Transportation reported 219 pedestrian death statewide in 2024.

Authorities closed all southbound lanes between Dempster Street and Touhy Avenue until approximately 11:30 a.m.

How common are work zone pedestrian collisions on Illinois interstates?

Highway maintenance crews face significant risks from passing traffic, particularly during early morning hours when visibility is reduced. In pedestrian accidents such as this, safety analysts point to driver inattention, excessive speed, and failure to obey Move Over laws as recurring factors.

Candice Bond, managing partner at Bond Legal, said, "Pedestrians working in active roadway zones operate under inherent visibility constraints that extend well beyond simple driver neglect. Many fatal collisions stem from drivers traveling too fast for conditions, failing to recognize warning systems, or becoming distracted by cellular devices while navigating construction areas."

Legal counsel works to preserve traffic-control documentation, obtain vehicle data-recorder information, and coordinate thorough reconstruction analysis, added Bond, who is also a national legal analyst for Accident News.

What legal options exist for families of deceased highway workers?

While the official investigation continues, independent crash reconstructionists will review the driver's speed, phone records, and adherence to work zone speed limits. Families of victims killed in work zones often pursue third-party liability claims against the at-fault driver alongside standard workers' compensation benefits.

"Serving as an advocate, an attorney can act quickly after a fatal crash to protect surviving family members, preserve key evidence, safeguard legal rights, and pursue compensation while addressing challenges that arise during the claims process," nonted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.

Illinois wrongful death statute

Under 740 ILCS 180, surviving family members may file a wrongful death action. Illinois applies modified comparative fault (50% bar). The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of society, and grief.
