Chaw-Long Shih Killed in Austin Hit-and-Run Accident

Police are searching for a blue Honda Civic that fled the scene on West 35th Street
Chaw-Long Shih, 65, was killed in a hit-and-run crash in the 1800 block of West 35th Street in Austin, Texas, early Sunday, according to the Austin Police Department.
Paramedics arrived at the scene around 5:20 a.m. and rushed the severely injured bicyclist to a local hospital. Detectives are actively searching for a 2016 to 2018 blue Honda Civic with front-end damage that fled the area immediately after the collision.
Shih remained hospitalized for three days before he was pronounced dead on Wednesday.
The Vehicular Homicide Unit is leading the criminal investigation into the city's 43rd traffic death of the year.
Authorities are urging anyone with information about the suspect vehicle to contact Capital Area Crime Stoppers.
Hit-and-run death have reached crisis levels nationwide. According to the AAA Foundation for Traffic Safety, fatal hit-and-run crashes reached an all-time high of 2,972 in 2022, with pedestrians and cyclists accounting for more than 70% of the victims.
The sudden loss of a family member in a hit-and-run leaves surviving relatives grappling with deep grief and a desire for accountability. While the Vehicular Homicide Unit works to identify the driver of the blue Honda Civic, legal professionals note that parallel civil investigations are often necessary to protect the estate's rights.
How will investigators track the blue Honda Civic on West 35th Street?
Detectives typically canvas nearby businesses and traffic cameras to piece together a suspect's escape route following an early morning collision.
Candice Bond, managing partner at Bond Legal, said, "Security cameras near busy intersections hold footage getting erased within days without a prompt request from a nearby business owner or property manager. A narrow window makes early action essential for serious roadway collisions involving a driver never stopping at any point."
"Legal counsel reaches out to nearby businesses right away, preserving recordings before automatic deletion erases critical proof forever," added Bond, who is also a national legal analyst for Accident News.
What legal options exist for Shih's family?
Even when a suspect is actively evading police, families of victims have avenues for civil recourse. Uninsured drivers coverage can sometimes provide a path to recovery when an at-fault driver remains unidentified.
The ongoing criminal investigation by Austin police will run parallel to any civil claims pursued by the estate. Families navigating this process often rely on independent investigations to preserve critical evidence before it disappears from a crash site.
Texas wrongful death statute
Under Tex. Civ. Prac. & Rem. Code § 71.001, surviving family members may file a wrongful death action. Texas applies modified comparative fault (51% bar). The statute of limitations is 2 years.
Recoverable damages may include loss of financial support, loss of companionship and consortium, funeral expenses, and mental anguish.
"Bicyclists face constant and serious danger daily on busy public roads across the entire country, where limited visibility, driver distraction, and unsafe passing frequently contribute to severe injuries and fatal collisions on any given day," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
