Daniel Martinez Killed in Fresno Car Accident

Daniel Martinez car accident on Gettysburg Avenue, Fresno, California

63-year-old man and his dog die after being rear-ended by truck on Gettysburg Avenue

Daniel Martinez, 63, of Fresno, was killed in a rear-end crash at the corner of Maple and Gettysburg avenues in Fresno on July 13, according to police.‍‍‌‌‌‍‌‍‍‍‍‍‌‌‍‌‍‍‌‌‌‌‌‍‍‍‌‍‍‌‌‌‍‌‍‍‍‍‍‌‌‍‌‍‍‌‌‌‌‌‍‍‍‌‍‍‌‌‌‍‌‍‍‍‍‍‌‌‍‌‍‍‌‌‌‌‌‍‍‍‌

Paramedics and officers arrived at the scene shortly after 11:40 a.m. to find heavy damage across multiple vehicles. The eastbound vehicle driven by Martinez was struck from behind by a white truck, pushing the wreckage into two unoccupied cars parked along the street.

Martinez was pronounced dead at the scene. A dog traveling in his vehicle was also killed in the crash. The driver of the white truck was taken to a local hospital with major injuries.

Fresno Police closed Gettysburg Avenue west of Highway 168 for several hours while investigators examined the crash site.

The department has not announced any charges as detectives continue to review the circumstances leading to the collision.

How do intersection dynamics impact crash severity?

Rear-end collisions at intersections frequently result in severe trauma, particularly when significant speed differentials exist between vehicles.

In car accidents such as this, crash reconstruction investigators analyze skid marks, vehicle data recorders, and impact angles to determine fault.

Candice Bond, managing partner at Bond Legal, said, "Rear-end collisions become fatal when drivers maintain inadequate following distance and travel at speeds preventing safe stopping. Traffic congestion, sudden deceleration, and highway speeds combine dangerously, creating chain-reaction crashes with catastrophic forces."

"A legal team investigating such collisions examines event data recorders, brake systems, and maintenance to establish contributing factors and protect surviving relatives through evidence preservation and insurance coordination," added Bond, who is also a national legal analyst for Accident News.

What is the status of the Fresno investigation?

Detectives continue to review evidence from the Gettysburg Avenue crash site to understand why the white truck failed to stop. While the exact sequence remains under review, families facing the sudden loss of a relative often encounter immediate financial and administrative burdens.

California recorded 3,807 traffic deaths in 2024, and intersections remain a frequent site for severe collisions across the state.

California wrongful death statute

Under Cal. Code Civ. Proc. § 377.60, surviving family members may file a wrongful death action. California applies pure comparative fault. The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and the decedent's pre-death pain and suffering.

"An attorney protecting bereaved relatives navigates policy language, negotiates with adjusters, pursues underinsured motorist coverage, and compels fair settlement to ensure families receive compensation matching losses through wrongful death," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
