David Javurek Killed in Bohemia Motorcycle Accident

David Javurek fatal motorcycle accident on Lakeland Avenue, Bohemia, New York

The collision occurred at the intersection of Lakeland Avenue and Peter Lane

David Javurek, 39, of Sayville, died Wednesday in a motorcycle crash on Lakeland Avenue near Peter Lane in Bohemia, Suffolk County police said.

The crash happened around 7:50 a.m. Javurek was riding a northbound 2004 Kawasaki motorcycle when it collided with a 2024 Nissan Pathfinder. The SUV driver was turning left from a side street into the southbound lanes, police said.

Paramedics rushed Javurek to NYU Langone Hospital-Suffolk, where he was pronounced dead. The driver of the Nissan, a 41-year-old woman, was taken to Stony Brook University Hospital with injuries that were not life-threatening.

Police impounded both vehicles for safety checks. No charges have been filed, and the crash remains under investigation, police said.

What factors are investigators examining on Lakeland Avenue?

The sudden loss of a loved one leaves families and communities searching for answers, especially when a routine morning commute ends in tragedy. While police investigate the exact sequence of events at the Peter Lane intersection, legal practitioners who study motorcycle collisions note that left-turn crashes represent a significant hazard for riders.

"While no amount of money can replace a lost loved one, the importance of contacting and securing a wrongful death lawyer cannot be stressed enough. It is a wrongful death attorney’s duty to assist families whose lives have been suddenly impacted. Our goal is to help those affected to ultimately assist in establishing normalcy after an untimely death." said Candice Bond, Managing Partner at Bond Legal.

According to the National Highway Traffic Safety Administration, 6,335 motorcyclists died in traffic crashes nationwide in 2023, accounting for 15% of all traffic deaths despite motorcycles making up only 3% of registered vehicles. In New York, urban and suburban corridors frequently see collisions where turning vehicles fail to yield the right-of-way.

What happens next for the Sayville community and the victim's family?

As the Sayville community mourns, the investigative focus will shift to liability and right-of-way rules. Insurance adjusters often contact involved parties within days of a crash, before the full extent of the investigative findings are released.

"What car drivers don't realize is that forty-two percent of fatal motorcycle crashes happen at intersections. When a car turns across a rider's path, there's almost no room for the biker to maneuver or escape," said Stefano Formica, of Counsel at Bond Legal

New York wrongful death statute

Under N.Y. EPTL § 5-4.1, surviving family members may file a wrongful death action. New York applies pure comparative fault. The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of parental guidance, funeral expenses, and the decedent's conscious pain and suffering.
