Francisco Garcia Killed in Bronx Hit-and-Run Accident

Francisco Garcia killed in hit-and-run on Bruckner Expressway, Bronx, New York

New York City police seek driver of 2020 Kia Telluride after fatal collision

Francisco Garcia, 71, died Saturday after a hit-and-run crash on the Bruckner Expressway in the Bronx, police said.

Garcia was walking along the westbound shoulder of the expressway near White Plains Road around 4:45 a.m. when a 2020 Kia Telluride hit him, police said. Paramedics rushed him to a hospital, where he was pronounced dead.

The driver of the Kia fled the scene. Investigators found the SUV abandoned near Underhill and Watson avenues shortly after the crash.

No arrests have been made, and the crash remains under investigation, police said.

Police asked anyone with information to call Crime Stoppers at 1-800-577-TIPS (8477).

The abandonment of the 2020 Kia Telluride on a nearby street suggests a deliberate attempt to evade identification and prosecution. Investigators examine every detail at a crash scene, including vehicle fragments and surveillance footage, to piece together what happened. Without a driver, securing such evidence becomes even more critical.

Candice Bond, Bond Legal, noted that "Having the proper resources is crucial to investigating a hit-and-run accident case and proving negligence. Road conditions, signage visibility, and road lighting are all potential contributing factors that are considered and must be thoroughly examined. These procedures are necessary for helping someone who has lost a loved one at the hands of a hit-and-run driver receive the justice and monetary compensation that they deserve."

Modern forensic techniques are vital in hit-and-run investigations. Detectives analyze paint chips, tire marks, and debris left behind at the crash site. Additionally, traffic camera footage, nearby business surveillance, and witness statements can help identify the fleeing vehicle and driver. These elements often provide the important links needed to bring those responsible to justice.

Pedestrian safety on high-speed roadways like the Bruckner Expressway is a significant concern. While pedestrians should avoid walking on expressways, communities often implement educational campaigns about safe road use. Furthermore, urban planners may explore barriers or fencing in high-risk areas to prevent pedestrian access where it is unsafe.

Witnesses are often the eyes and ears for investigators, providing critical details about the vehicle, driver, or direction of travel. In hit-and-run incidents, even a partial description can be invaluable. Authorities rely on community assistance to solve these cases, urging anyone with information to come forward and assist in the effort to hold negligent drivers accountable.

Under N.Y. EPTL § 5-4.1, surviving family members may file a wrongful death action. New York applies pure comparative fault. The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of parental guidance, funeral expenses, and the decedent's conscious pain and suffering.
