A Tesla driven by a 65-year-old Thousand Oaks woman left the road and struck the building, trapping a person underneath the electric vehicle. Investigators noted the driver did not appear to be impaired at the scene.

Rescuers responded to the commercial area, but the victim was pronounced dead. She had been running errands at the time of the collision.

Authorities are working to determine what caused the driver to lose control. No criminal charges were immediately announced as the investigation continues.

The crash remains under investigation by local police.

Why did the Tesla jump the curb in Simi Valley?

While preliminary reports indicate the driver was not impaired, investigators will examine the vehicle's event data recorder, mechanical systems, and the driver's actions leading up to the collision.

In pedestrian accidents such as this, crash reconstructionists look closely at vehicle speed and potential pedal misapplication.

Candice Bond, managing partner at Bond Legal, said, "Distraction behind the wheel can steal attention for only a moment, but the instant often coincides precisely with someone stepping into a crosswalk or roadway shoulder, leaving no room to brake or swerve. Phones, dashboard screens, and wandering focus play a role."

"Serving as an advocate, an attorney pulls cellphone records and event data recorder information to establish what happened," added Bond, who is also a national legal analyst for Accident News.

According to the California Office of Traffic Safety, the state recorded 1,106 pedestrian death in 2023, with non-intersection locations accounting for the vast majority of fatal pedestrian crashes.

What are the legal options for a victim's family?

Families navigating the sudden loss of a loved one face a complex path to justice, especially when a vehicle leaves the road and strikes a pedestrian on a sidewalk. The investigation will determine liability and whether the driver's auto insurance will be responsible for damages.

The victim's family has publicly expressed their grief, remembering her as a devoted mother and grandmother who volunteered at the Getty Villa Malibu for two decades.

California wrongful death statute

Under Cal. Code Civ. Proc. § 377.60, surviving family members may file a wrongful death action. California applies pure comparative fault. The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and the decedent's pre-death pain and suffering.

"A legal team often works to document funeral expenses, medical bills and lost income when pursuing compensation for grieving families. Careful documentation helps surviving relatives receive fair consideration for financial hardship created by a sudden and unexpected loss of life," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
